Terms and Conditions of Harry and David Deluxe Tower of Treats® Sweepstakes
1. ONLINE METHOD: During the Entry Period, visit www.silverplanet.com, click on the Sweepstakes banners, buttons, and/or links, and follow the instructions to become a registered member of the Web site. Once you successfully register online, providing your complete name, date of birth, ZIP/postal code, and email address, you will be automatically entered in the Sweepstakes. All registered members who nominate a Silver Star through the official contact form on the Web site, and all registered members of MySeniors.com as of July 1, 2008, will also be automatically entered in the Sweepstakes. To be eligible, all registered members must provide all nominee information requested, including (1) referral name, (2) name of nominee, (3) reason for nomination, and (4) contact number or email address of the nominee. All information submitted by entrants is subject to SilverPlanet.com's Privacy Policy. Entrants must provide all required data requested on the online registration form. Incomplete entries or nondeliverable email addresses are void. Drawing is void where prohibited.

2. RANDOM DRAWING: On the last day of each month, beginning on July 31, 2008, and continuing for a period of three (3) months, the potential winners of the Sweepstakes (the "Winner") will be selected by random drawing, from all eligible entries received by Silver Planet. The deadline for consideration in the drawing will be 10 a.m. (MST) on the morning of the drawing date. The decisions of Sponsor, including the selection of winners, are final and binding on all matters relating to this Sweepstakes. All prizes will be awarded. Prizes are limited to one per person, family, or household. Winners are ineligible for another prize from a drawing at www.silverplanet.com for three (3) months from date of win.
3. PRIZES: Three (3) prizes will be awarded per month. Each Winner will receive one (1) Deluxe Tower of Treats from Harry and David. The estimated verifiable prize retail value is $66. The Winner is fully responsible for any and all applicable federal, state, and local taxes. The Prize is nontransferable and nonassignable, with no cash redemptions or substitutions except at Sponsor's sole discretion. There will be no substitutions for the Prize unless it is unavailable, in which case another gift of equal value to the face value of the Prize will be awarded at the exclusive discretion of the Sponsor.
4. ODDS OF WINNING: Odds of winning are determined by the number of eligible entries received.
5. NOTIFICATION: The potential Winner will be notified by email by the Sponsor. In the event that the Winner does not respond to any such notification within forty-eight (48) hours of notification, a disqualification will result and an alternate winner shall be chosen from among all remaining eligible entries. The potential Winner will be required to execute and return an Affidavit of Eligibility and Release of Liability and, unless prohibited by law, Publicity Release, within seven (7) days of date of receipt. A disqualification will result and an alternative winner will be randomly selected from among all remaining eligible entries if all required documents are not properly executed and returned within the specified period. Refusal or return of such documents as nondeliverable or potential Winner's noncompliance with these Official Rules will also result in disqualification and cause an alternative winner to be chosen from among all remaining eligible entries.
6. WAIVER OF LIABILITY/PUBLICITY RELEASE: By participating in the Sweepstakes and submitting an entry, all entrants agree to (i) be bound by these Official Rules, including all entry requirements, and (ii) waive any and all claims against the Sponsor and advertising and promotion agencies, and any and all other companies associated with the Sweepstakes, and all of their respective officers, directors, employees, agents and representatives (collectively, "Released Parties") for any injury, damage or loss that may occur, directly or indirectly, in whole or in part, from the participation in the Sweepstakes or from the receipt or consumption of any prize. By acceptance of Prize, the Winner grants to Sponsor the right to publicize such Winner's name, city and state, and/or likeness in any medium now or hereafter devised worldwide without limitation, including for publicity and promotional purposes on Silver Planet’s Web sites and in its marketing materials, and without additional compensation or consideration, notification, or permission, unless prohibited by law.
7. GENERAL CONDITIONS: Participation in this drawing is limited to U.S. residents who are over 18 years of age. Employees or affiliates of Silver Planet are not eligible to participate in the Sweepstakes. Void where prohibited. Released Parties are not responsible for printing or typographical errors in any Sweepstakes-related materials or for late, lost, damaged, garbled, delayed, misdirected, damaged, incomplete, or inaccurate entries. Sweepstakes entries generated by a script, macro, or other mechanical or automated means will be disqualified. Released Parties are not responsible for incorrect, inaccurate transcription; loss or delay of entry or prize reply information; any viruses transmitted to computers of participants via the Internet; or for any technical or human errors associated with the Sweepstakes. If, in the Sponsor's exclusive judgment, this promotion becomes compromised in any way, Sponsor reserves the right to withdraw the promotion offer, cancel any method of entry, void any entries submitted fraudulently, and/or select winners from all eligible entries received prior to the act(s) that compromised the promotion.
Persons who tamper with or abuse any aspect of the Sweepstakes or Web site or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated entries will be voided. Any attempt to deliberately damage the content or operation of this Sweepstakes is unlawful and subject to legal action by the Sponsor, who shall have the sole right to disqualify any entrant for violation of these Official Rules or any applicable laws relating to the Sweepstakes, and to resolve all disputes in their sole discretion.
Sponsor (i) makes no warranty, guaranty, or representation of any kind concerning any prize, and (ii) disclaims any implied warranty. All disputes will be resolved under applicable U.S. laws in the County of El Paso, State of Colorado. Sponsor reserves the right, in its sole discretion, to cancel or suspend the Sweepstakes should viruses, bugs, unauthorized human intervention, or other causes corrupt the administration, security, fairness, integrity, or proper operation of the Sweepstakes. In the event of cancellation, Sponsor may elect to identify winners and award the Prize by way of random drawing from among all nonsuspect eligible entries received up to the time of such cancellation.
All online entries must include a valid email address for the entrant. Participants who submit multiple registrations for the same person will be disqualified. In the event of dispute as to the identity or eligibility of a winner based on an email address, the winning entry will be declared by the "Authorized Account Holder" of the email address submitted at the time of the entry provided he or she is eligible according to these Official Rules. The "Authorized Account Holder" is the person to whom the applicable Internet service provider or other organization (such as business or educational institution) has assigned the email addresses for the domain associated with the submitted email address.
8. WINNERS' LIST: The names of the potential winners will be posted on the Web site within three (3) days of the date that the winning entry is selected but are subject to verification and compliance with all rules as stated herein. For a list of winners, mail a self-addressed stamped envelope to Silver Planet, 15745 Roller Coaster Rd., Colorado Springs, CO 80921. Winners' list requests must be made by December 31, 2008.
